Key provisions · Claude summary, not statute text

Establishes the process for distributing the draft regional housing need allocation, hearing appeals, adjusting shares, and adopting the final allocation plan.

  • Draft allocation. At least one and one-half years before the scheduled § 65588 revision, the COG or delegate subregion must distribute a draft allocation based on the adopted methodology to each local government and HCD and post it online, with underlying data, methodology, and a statement of how it furthers § 65584(d) objectives. The draft must distribute the entire regional (or subregional) housing need. (a)
  • Appeals. Within 30 days of receiving the draft, a local government or HCD may appeal for revision of one or more shares, using comparable data and accepted methodology with adequate documentation, consistent with the sustainable communities strategy. Appeals are limited to failure to consider § 65584.04(b) information, failure to follow the methodology and objectives, or a significant and unforeseen change in circumstances (appealable only by the affected jurisdiction). (b)(1)–(3)
  • Comment period. After the appeal period, the COG must notify all local governments and HCD of all appeals and post supporting materials online; comments may be submitted within 45 days. If no appeals are filed, the draft may be adopted. (c)
  • Appeal hearing. No later than 30 days after the comment period, with at least 10 days’ notice, the COG must hold one public hearing on all appeals and comments. (d)
  • Final determinations. Within 45 days after the hearing, the COG must make written final determinations accepting, rejecting, or modifying each appeal with findings, issue a proposed final allocation plan, submit it to HCD, and set a hearing date for adoption; a determination may adjust shares of non-appealing jurisdictions. (e)(1)–(4)
  • Redistribution. If appeal adjustments total 7 percent or less of the regional (or subregional) need, they are distributed proportionally to all local governments; if over 7 percent, the COG must develop a methodology to distribute the excess. Total distribution may not fall below the regional or subregional need. (f)
  • Adoption and HCD check. Within 45 days after the proposed final plan, the COG holds a public hearing to adopt it, has final authority over distribution if the regional need is fully allocated and appeals considered, and must submit it to HCD within three days. HCD has 15 days to determine consistency with the regional need and may revise to achieve it. (g)
  • Limits on authority. COG authority to revise a jurisdiction’s share does not include authority over how the jurisdiction implements its share through its housing program. (h)
  • Time periods. Time periods in (d) or (e) may be extended up to 30 days, and periods in (b), (c), (d), (e), or (g) may be shortened to speed adoption, but not below 10 days. (i)
  • San Diego exception. The San Diego Association of Governments may follow this process for the sixth revision even before adopting an updated regional transportation plan and sustainable communities strategy. (j)
