Authorizes HCD to review rental inclusionary ordinances requiring more than 15% affordable units at 80% AMI in jurisdictions with low above-moderate production or missing annual reports, through an economic feasibility study.

  • Trigger. Applies to ordinances adopted or amended after September 15, 2017, requiring more than 15% of rental units at 80% AMI or less, if the jurisdiction met less than 75% of its prorated above-moderate RHNA over at least five years, or failed to submit annual housing element reports for at least two consecutive years. (a)
  • Feasibility study. HCD may request an economic feasibility study, due within 180 days; review is limited to whether it was prepared by a qualified entity, posted online for at least 30 days and placed on a legislative body agenda (if prepared after September 15, 2017), and used rigorous best-practice methodology. (b)
  • 15% cap. If no study is submitted within 180 days, or HCD’s final decision finds it deficient, the requirement is limited to no more than 15% of units at 80% AMI until a compliant study is accepted. (c), (d)(3)
  • Review and appeal. HCD must make a finding within 90 days; the jurisdiction may appeal to the HCD Director, who must decide within 90 days unless extended by mutual agreement. (d)(1)–(2)
  • Limits and reporting. HCD may not request a study more than 10 years after the ordinance’s adoption or amendment, must report findings annually to the Legislature, and the section applies to charter cities. (e)–(g)
