Key provisions · Claude summary, not statute text

Authorizes content-neutral time, place, and manner regulation of sexually oriented businesses.

  • Regulation. Ordinances must serve a substantial governmental interest, not unreasonably limit alternative avenues of communication, and use narrow, objective, definite standards; legislative bodies may rely on other jurisdictions’ experience and court findings on secondary effects, including proximity to churches, schools, residences, and alcohol establishments. (a)
  • Definition. A sexually oriented business is one whose primary purpose is selling or displaying sexually explicit matter that may be offered only to persons over 18. (b)
  • Other authority. The section does not preempt regulation permitted by the U.S. and California Constitutions, authorizes cooperative agreements or joint powers authorities with adjacent jurisdictions, and allows consideration of secondary effects on adjacent cities and counties. (c)–(e)
