Key provisions · Claude summary, not statute text

Sets out how each council of governments (COG) or delegate subregion develops, takes public input on, submits to HCD, and adopts the methodology for allocating the regional housing need to local jurisdictions.

  • Methodology timing. At least two years before a scheduled § 65588 revision, each COG or delegate subregion must develop, in consultation with HCD, a proposed methodology distributing existing and projected regional housing need that furthers the § 65584(d) objectives. (a)
  • Jurisdiction survey. No more than six months before developing the methodology, the COG must survey member jurisdictions on the subdivision (e) factors and compile fair housing information from Analyses of Impediments, Assessments of Fair Housing, and housing elements, in a comparable format using readily available data. The survey must state that the information may not be used to reduce the regional total; if no survey is done, jurisdictions may submit information before the public comment period. (b)(1)–(5)
  • Fair housing report. The COG must electronically report the fair housing survey results, describing common themes and effective strategies (including avoiding displacement of lower income households), identify significant regional barriers to affirmatively furthering fair housing, and may recommend strategies; the information may be used for other purposes such as the regional transportation plan. (c)
  • Public participation. Public participation is required, including diligent outreach to all economic segments, protected classes under § 12955, and households with special housing needs. The proposed methodology, data, assumptions, and explanations must be distributed on request and posted online, and at least one public hearing must be held. (d)
  • Allocation factors. To the extent data is available, the COG must consider factors including jobs–housing relationship (including low-wage jobs and affordable units), development opportunities and constraints (sewer/water capacity, suitable land not limited to existing zoning, protected lands, county farmland policies, evacuation capacity, wildfire, sea level rise and climate impacts), transportation plan growth, county–city growth agreements, loss of assisted units, cost burden over 30% and 50%, overcrowding, farmworker needs, homelessness, units lost in a declared state of emergency, greenhouse gas targets, and the sustainable communities strategy. (e)(1)–(8), (10)–(13)
  • University housing. The COG considers housing needs generated by private universities and CSU and UC campuses; no more than six months before methodology development, the UC Regents are requested to, and CSU Trustees shall, provide enrollment forecasts and share them with state officials, beginning the seventh cycle (eighth cycle for Humboldt, Lake, and Mendocino COGs), and provide trip and travel data on request. (e)(9)
  • Other factors. The COG may adopt other factors that further § 65584(d) objectives if it specifies which objective each furthers, and may include unrelated factors only if they do not undermine those objectives, apply equally across income levels, and are found necessary to address significant health and safety conditions. (e)(14)
  • Written explanation. The COG must explain in writing how each factor was incorporated and how the methodology furthers § 65584(d) objectives; the methodology may use numerical weighting, and supporting materials must be posted online. (f)
  • Prohibited justifications. A jurisdiction’s share may not be determined or reduced based on local limits on residential building permits, prior underproduction as shown in annual production reports, or stable population from the previous cycle. (g)
  • HCD review. After the comment period and revisions, the COG publishes the draft methodology and submits it to HCD, which has 60 days to issue written findings on whether it furthers § 65584(d) objectives. If not, the COG must revise it within 45 days in consultation with HCD and obtain HCD acceptance before adopting a final methodology; the COG may act if HCD findings are late. (h)–(j)
  • Adoption notice. After adoption, the COG must notify jurisdictions and HCD and publish the methodology, resolution, and findings online; HCD may review the adopted methodology within 45 days. (k)–(l)
  • Final allocation plan. The allocation plan must be informed by the sustainable communities strategy, maintain the total regional need by income category, give every jurisdiction an allocation of low- and very low income units and, starting the seventh revision, acutely low and extremely low income units. The approving resolution must show the plan is informed by the SCS and furthers § 65584(d) objectives. (m)(1)–(3)
  • Operative date. The section becomes operative January 1, 2025. (n)
