Cities and counties without a council of governmentsTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 3. Local Planning › ARTICLE 10.6. Housing Elements

Key provisions · Claude summary, not statute text

Governs how HCD determines and distributes regional housing need for cities and counties that have no council of governments, including local revision requests and hearings.

  • HCD distribution. For cities and counties without a COG, HCD determines and distributes housing need under §§ 65584 and 65584.01, but must delegate the responsibility to a county or counties and their cities if supported by a board of supervisors resolution and a majority of cities representing a majority of the population, and HCD finds they have the capability and resources. (a)
  • Considerations. Distribution must consider market demand, household growth in the regional transportation plan, jobs and commuting, suitable sites and public facilities, homelessness, county–city growth agreements, and other agreed considerations such as evacuation route capacity, wildfire risk, sea level rise, and climate impacts. HCD must provide data on its assumptions and methodology; site consideration is not limited to existing zoning, and inadequately flood-protected land may be excluded. (b)
  • Revision requests. Within 90 days of HCD’s draft distribution, a city or county may propose a revised share based on comparable data, accepted planning methodology, and adequate documentation. (c)
  • HCD response and hearing. Within 60 days after the 90-day period, HCD must accept, modify, or explain why the revision is inconsistent. If not accepted, the city or county may request a public hearing within 30 days, must be notified by certified mail within 30 days, and the hearing must be 10 to 15 days after notice; HCD must respond in writing to each revision request. (d)(1)–(5)
  • Effect of decision. An accepted or modified share is used; otherwise the original share applies. HCD must maintain the total regional need, issue a written final determination explaining consistency, and may adjust non-requesting jurisdictions. (e)
  • Final allocation. HCD must issue the final allocation within 45 days of the end of local review, and later statutory changes are not a basis for revising it. (f)–(g)
  • Operative date. The section becomes operative January 1, 2025. (h)
