Key provisions · Claude summary, not statute text

Specifies alternative ways a city or county may identify adequate sites in its housing element, including counting committed-assistance units for up to 25 percent of the sites obligation and crediting units built early in the projection period.

  • Methods for sites. HCD may allow adequate sites to be identified by methods including redesignation to more intense land use and increased density, and may allow ADU sites based on prior-period ADU production, need, and available incentives; the total sites obligation by income category is not reduced. (a)
  • Military base housing. Permanent housing units on a military base undergoing closure or conversion may count as adequate sites if available for occupancy during the planning period; units planned for demolition or nonresidential conversion do not qualify. (b)
  • Committed assistance substitution. HCD may allow up to 25% of the adequate sites obligation for any income category to be met one-for-one by units made available through “committed assistance” to lower income households at affordable costs, under a program identifying dedicated funding sources, the units by income level, and compliance with eligibility rules. (c)(1)
  • Eligible units. Qualifying units are those substantially rehabilitated (imminent risk of loss, relocation assistance, right to reoccupy, at least four § 17995.3 violations, 55-year covenants); converted from nonaffordable to affordable in foreclosed or 3+ unit complexes; preserved at-risk assisted units; COVID-19 motel or hotel conversions for people experiencing homelessness (sixth revision only); and mobilehome park acquisitions meeting financing or rent-limit conditions. (c)(2)(A)–(E)
  • Conversion conditions. Converted and preserved units generally require 55-year covenants, decent, safe, and sanitary condition, no eminent domain, and relocation assistance of at least four months’ rent plus moving expenses; ownership or foreclosed conversions require an equal number of new lower income rental units built in the same period. (c)(2)(A)–(C)
  • Exclusions. The subdivision does not apply to a jurisdiction that met none of its low- and very low income RHNA in the current or prior planning period; jurisdictions must document issued permits and paid fees or lawful occupancy eligibility. (c)(3)
  • Definitions. Defines “committed assistance” (an enforceable agreement made by the end of the third year obligating funds, with occupancy within two years, excluding tenant-based assistance), “net increase,” and “the time the unit is identified.” (c)(4)–(6)
  • Progress reporting. In the fourth year, jurisdictions with such programs must report progress to the legislative body and HCD within 30 days; if committed assistance is not in place for all units by the end of the third year, the element must be amended by the end of the fourth year to identify additional sites, or the jurisdiction is limited in the next planning period. (c)(7)
  • Early production credit. A jurisdiction may reduce its RHNA by units built between the start of the projection period and the adoption deadline, describing the methodology for assigning units to income categories. (d)
