Key provisions · Claude summary of the digest, not bill text

Expanded ministerial approval of small-lot subdivisions and housing on subdivided lots by loosening lot, parcel size, setback, and height rules, effective for applications received on or after January 1, 2027, and added related annual reporting.

  • Height and setbacks. Required height limits on qualifying subdivided lots to apply to a building's physical height rather than number of floors, prohibited specified front or internal setbacks, modified density prohibitions, and required liberal interpretation in favor of maximum housing units.
  • Lot eligibility. Replaced the requirement that lots be substantially surrounded by qualified urban uses with other specified site requirements, changed lot density requirements, and redefined "vacant" as having no permanent structure unless abandoned or untenantable.
  • Smaller parcels. Allowed newly created parcels on multifamily-zoned land as small as 480 or 960 square feet if conditions are met, and limited any parcel created through lot size averaging to no more than 50% of the original parcel size, except as specified.
  • Unit size calculation. Revised "net habitable square feet" to exclude stairs and enclosed bicycle parking for the 1,750 square foot average unit size limit.
  • Effective date. Applied the subdivision changes to applications received by local agencies on or after January 1, 2027.
  • Annual reporting. Beginning with the April 1, 2028, annual report, required information on housing projects received under these subdivision provisions, and also required information on surplus land disposal.
  • Private restrictions. Made unenforceable any covenant, condition, or restriction that prohibits or physically precludes a housing project on a qualifying subdivided lot, except within common interest developments.
