ADU ordinances: required standardsTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 13. Accessory Dwelling Units › ARTICLE 2. Accessory Dwelling Unit Approvals

Key provisions · Claude summary, not statute text

Authorizes a local agency to adopt an ordinance allowing accessory dwelling units in single-family and multifamily residential zones, and lists what that ordinance must contain.

  • Designated areas. The ordinance must designate where ADUs may be permitted, which may be based on adequacy of water and sewer service and impacts on traffic flow and public safety; an agency that does not provide water or sewer must first consult the service provider. (a)
  • Objective standards. The ordinance must impose objective standards such as parking, height, setback, landscape, architectural review, maximum unit size, and protection of properties on the California Register of Historical Resources, but may not include minimum lot size requirements. The agency may reduce or eliminate ADU parking. (b)
  • Density and consistency. ADUs do not exceed the lot's allowable density and are a residential use consistent with the existing general plan and zoning designation. (c)
  • Sale and location. ADUs may be rented but not sold or conveyed separately from the primary residence (except under Article 4, § 66340 et seq.). The lot must be zoned for single-family or multifamily use with a proposed or existing dwelling, and the ADU may be attached, within the dwelling (including garages), or detached on the same lot. (d)(1)–(3)
  • Size limits. An attached ADU may not exceed 50 percent of an existing primary dwelling's floor area, and a detached ADU may not exceed 1,200 square feet. (d)(4)–(5)
  • Passageways and setbacks. No passageway may be required. No setback may be required for converted existing living areas or accessory structures, or structures rebuilt in the same location and dimensions; other ADUs may be required to have no more than four-foot side and rear setbacks. (d)(6)–(7)
  • Building code and sewage. Local building code requirements for detached dwellings apply, but an ADU is not a Group R occupancy change unless the building official makes a written finding, based on substantial evidence, of a specific adverse impact on public health and safety. Local health officer approval is needed where a private sewage disposal system is used, if required. (d)(8)–(9)
  • Parking. Parking may not exceed one space per ADU or per bedroom, whichever is less, and may be tandem on a driveway; offstreet parking must be allowed in setbacks or tandem unless specific findings of infeasibility are made. These limits do not apply to ADUs described in § 66322. Garages, carports, or parking spaces demolished or converted for an ADU need not be replaced. (d)(10)–(11)
  • Fire sprinklers. ADUs need not have fire sprinklers if the primary residence does not, and an ADU does not trigger sprinklers in the existing primary dwelling. (d)(12)
  • Garage demolition. A demolition permit for a detached garage being replaced by an ADU must be reviewed and issued with the ADU application, and no written notice or placard is required unless the property is in an architecturally and historically significant historic district. (e), (f)
