Ministerial approval and review timelineTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 13. Accessory Dwelling Units › ARTICLE 2. Accessory Dwelling Unit Approvals

Key provisions · Claude summary, not statute text

Sets the ministerial permit process, completeness and approval deadlines, denial comments, and appeal rights for ADU applications.

  • Ministerial review. ADU permit applications must be considered and approved ministerially without discretionary review or a hearing, notwithstanding §§ 65901 or 65906 or local variance or special use permit rules. (a)(1)
  • Completeness. The permitting agency must determine completeness and notify the applicant in writing within 15 business days, with a list of incomplete items and how to cure them. A resubmittal may not be required to include items not on the list, is subject to the same timeline, and an untimely determination means the application is deemed complete. (a)(2)
  • 60-day decision. The agency must approve or deny within 60 days of receiving a complete application when there is an existing dwelling on the lot; if submitted with a new dwelling application, the ADU decision may be delayed until that decision, still without discretionary review. An applicant-requested delay tolls the period, and an application not acted on within 60 days is deemed approved. (a)(3)
  • Fees. The local agency may charge a fee to reimburse costs of implementing the section, including adopting or amending an ADU ordinance. (a)(3)
  • Denial comments. On denial, the agency must, within the same time period, give the applicant written comments listing defective or deficient items and how to remedy them. (b)
  • Grounds for delay. No local ordinance, policy, or regulation other than an ADU ordinance consistent with the article may be the basis for delaying or denying a building or use permit. (c)
  • Appeals. The agency must provide a written appeal of incompleteness or denial decisions to the governing body (or director if none); for a city or county, to the governing body or, at its option, the planning commission, or both. A final written determination is due within 60 business days of the appeal, and two levels of appeal do not extend that period. (d)
