Gov. Code § 65589.4

Attached housing as a permitted useTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 3. Local Planning › ARTICLE 10.6. Housing Elements

Key provisions · Claude summary, not statute text

Makes qualifying “attached housing developments” with specified affordability a permitted use not subject to a conditional use permit on parcels zoned for such development.

  • Permitted use. An attached housing development is a permitted use without a conditional use permit on any parcel zoned for it if local law so provides, or if it meets the affordability requirements of (b) and either meets Public Resources Code § 21159.22, 21159.23, or 21159.24 criteria or all criteria in (a)(2). (a), (a)(1)
  • CEQA and consistency. The project must be subject to a discretionary decision other than a CUP with an adopted negative declaration or mitigated negative declaration (after a public hearing if none is otherwise held), and be consistent with the zoning ordinance and general plan as of the date the application was deemed complete, disregarding zoning not yet conformed to the latest general plan. (a)(2)(A)–(B)
  • Recent plan coverage. The site must be covered by a general plan, general plan update including land use and circulation elements, community plan, or specific plan adopted within five years of the application being deemed complete. (a)(2)(C)
  • Size and density. No more than 100 units, with a minimum density of at least 12 units per acre, or at least 8 units per acre for four or fewer units. (a)(2)(D)
  • Location. Must be on an infill site in an urbanized area or a census-defined place with at least 5,000 persons per square mile, or, for 50 or fewer units, in an incorporated city with at least 2,500 persons per square mile and 25,000 total population. (a)(2)(E)–(F)
  • Affordability. At least 10% of units affordable to very low income, 20% to lower income, or 50% to moderate-income households at affordable housing cost, with legal commitments ensuring affordability for at least 30 years. (b)
  • Preserved requirements. Local design and site review standards existing when the application was deemed complete may still apply; the section is independent of § 65583(c) by-right site duties, does not apply to coastal development permits, and does not relieve compliance with CEQA or the Subdivision Map Act. (c)–(f)
  • Charter cities. Applies to all cities and counties, including charter cities, as a matter of statewide concern. (g)
  • Definitions. Defines “attached housing development” as a newly constructed or substantially rehabilitated structure of two or more dwelling units consisting only of residential units, excluding accessory dwelling units and condominium conversions. (h)
