Key provisions · Claude summary, not statute text

Exempts from CEQA residential projects of 100 or fewer units affordable to low-income households on small infill sites, subject to long-term affordability and the § 21159.21 criteria.

  • Affordability. The developer must provide legal commitments keeping units available to lower income households for at least 30 years at monthly housing costs determined under Health and Safety Code § 50053. (a), (a)(1)
  • Site conditions. The project must meet § 21159.21, and the site must be previously developed for qualified urban uses, or be immediately adjoined by qualified urban uses (or at least 75 percent of its perimeter adjoins developed qualified urban uses and the rest previously developed ones), with no parcel created within the prior 10 years; the site may not exceed five acres. (a)(2)(A)–(C)
  • Location. The site must be in an urbanized area or census-defined place of at least 5,000 persons per square mile, or, for 50 or fewer units, a city of at least 2,500 persons per square mile and 25,000 total population. (a)(2)(D)
  • Lower-density places. A project meeting all criteria except location is still exempt if in a city or census-defined place of at least 1,000 persons per square mile, unless there is a reasonable possibility of a significant effect on the environment or residents due to unusual circumstances or related or cumulative impacts of foreseeable nearby projects. (b), (c)
  • Definitions. “Residential” means residential units only, or residential units with primarily neighborhood-serving goods, services, or retail not exceeding 15 percent of total floor area. (d)
