Department determination of regional needTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 3. Local Planning › ARTICLE 10.6. Housing Elements

Key provisions · Claude summary, not statute text

Sets the process HCD follows, in consultation with councils of governments, to determine each region’s existing and projected housing need.

  • Population basis. The determination is based on Department of Finance projections and regional transportation plan forecasts; the council of governments’ forecast is used if within 1.5% of Finance’s, otherwise the parties seek agreement, failing which Finance’s projection (as modified by HCD) controls. (a)
  • Consultation data. HCD must consult on assumptions and methodology; the council provides data including household growth (with UC and CSU enrollment changes), household size, overcrowding (more than one resident per room), headship rates, vacancy rates (a healthy rental vacancy rate of no less than 5%), jobs-housing balance, cost burden (more than 30% of income), unreplaced emergency losses, and homelessness needs. (b)(1)
  • Consultation deadlines. HCD must consult at least 26 months before revision for the fourth through sixth revisions; for the seventh, 26 months (Humboldt, Lake, Mendocino, Nevada), 34 months (SLOCOG, SACOG), or 38 months for all others; and 38 months for the eighth and later. (b)(2)
  • Written assumptions. HCD may accept, reject, or adjust based on council data, and must provide written determinations on factor assumptions and methodology, which may adjust based on total projected households. (b)(3)
  • Determination and objections. HCD’s determination must reflect a feasible jobs-housing balance; within 30 days the council of governments may object on population projection or methodology grounds with documented alternatives, and HCD issues a final written determination within 45 days. (c)(1)–(3)
  • Limits. No city or county may object in regions where HCD distributes need under § 65584.06, and statutory changes after a final determination are not a basis for revising it. (c)(4), (d)
