Deadlines and challenges to housing elementsTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 3. Local Planning › ARTICLE 10.6. Housing Elements

Key provisions · Claude summary, not statute text

Sets the baseline housing element conformity deadline and governs judicial review of housing element compliance, including court-ordered compliance and rezoning.

  • Conformity deadline. Each city and county must bring its housing element into conformity with this article by October 1, 1981, and the § 65588 deadlines; the Director of Planning and Research may not grant extensions except as provided in § 65361(b). (a)
  • Judicial review. Any action by an interested party challenging a housing element’s conformity must be brought under Code of Civil Procedure § 1085, and review extends to whether the element substantially complies with this article. (b)
  • Inconsistent actions. If a court finds a local action required to be consistent with the general plan does not comply with the housing element, the jurisdiction must bring the action into compliance within 120 days, with the court retaining jurisdiction; the court may extend time if required HCD review is not timely completed. (c)(1)–(2)
  • Rezoning orders. If a court finds a failure to complete rezoning required by § 65583(c)(1)(A) (as extended under § 65583(f)), it must order completion within 120 days or the earliest time consistent with hearing notice requirements, retain jurisdiction, and may issue further orders including sanctions until the rezoning is complete. (d)(1)
  • Enforcement suits. Any interested person may sue under Code of Civil Procedure § 1085 to compel compliance with § 65583(c)(1)–(3) deadlines and requirements, and the jurisdiction bears the burden of proof. (d)(2)
