Transfers of allocation between a county and citiesTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 3. Local Planning › ARTICLE 10.6. Housing Elements

Key provisions · Claude summary, not statute text

Provides for transfers of regional housing need from a county to cities within it by voluntary agreement, upon incorporation of a new city, and upon annexation, and sets related housing element deadlines.

  • Voluntary transfers. Between adoption of the final allocation and the housing element due date, the assigning COG, subregional entity, or HCD must reduce a county’s share if one or more cities in that county agree to take an equivalent increase. (a)(1)–(2)
  • Proportional income shares. The county’s low and very low income share may be reduced only in proportion to its moderate and above moderate reduction; from the seventh revision on, this also covers extremely low and acutely low income shares. (a)(3)
  • Approval. The assigning entity must approve the reduction if conditions are met; the county and cities must submit an analysis with supporting data, and a COG or subregional entity must send its decision to HCD. (a)(4)
  • Element deadlines. Jurisdictions with voluntary transfers use the revised allocation and adopt elements by § 65588 deadlines; a newly incorporated city receiving a transfer must adopt or amend its element within 30 months of incorporation; a jurisdiction receiving an annexation transfer must amend within 180 days; each must identify sites for its revised need by those deadlines. (b)(1)–(4)
  • Public access. Materials and data justifying a revision must be made available to interested parties within seven days on payment of reasonable reproduction costs, unless waived for economic hardship. (b)(5)
  • New city incorporation. If a new city incorporates after the final allocation, a portion of the county’s allocation shall be transferred to it, by mutual agreement accepted by the allocating entity or, failing agreement, by that entity’s determination of units by income category on written request. (c)(1)
  • Incorporation timing. Within 90 days after incorporation, the agreed transfer or a written request must be submitted; an agreement is effective on receipt, and a requested transfer must be made effective within 180 days using the § 65584.04, 65584.03, or 65584.06 methodology as applicable. Transfers may not reduce the regional total or change other cities’ allocations, and the 90-day deadline may be extended. (c)(2)
  • Annexation transfers. If unincorporated land is annexed after the final allocation, a portion of the county’s allocation may be transferred to the city by agreement or by determination on request, following the same 90-day submission, 180-day effectiveness, methodology, and no-reduction rules. (d)(1), (d)(2)(A)
  • Development agreements. If annexed land is subject to a § 65865(b) development agreement entered before January 1, 2008, the revised determination is based on the units allowed by that agreement. (d)(2)(B)
  • No transfer. No transfer is made when the COG or HCD confirms the annexed land was fully incorporated into the methodology used for the city’s share. (d)(3)
