Certain cities in Los Angeles CountyTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 3. Local Planning › ARTICLE 10.6. Housing Elements

Key provisions · Claude summary, not statute text

Lets a Los Angeles County city incorporated to promote commerce and industry, with no residentially zoned land on January 1, 1992, adopt a housing element with no provision for new housing or RHNA share, so long as 20% of its redevelopment tax increment is transferred annually to the Housing Authority of the County of Los Angeles.

  • Eligible city. A city incorporated to promote commerce and industry, located in Los Angeles County, with no residentially zoned land on January 1, 1992, may adopt a housing element making no provision for new housing or its § 65584 regional housing need share for current and subsequent revisions, for as long as 20% of all tax increment revenue required to be set aside for low- and moderate-income housing under Health & Safety Code § 33334.2 is transferred annually to the Housing Authority of the County of Los Angeles. (a)
  • Transfer timing. The annual transfer amount is determined at the end of each fiscal year starting 1992–93 and must be transferred within 30 days of the agency receiving each tax increment installment, starting in 1993. (b)(1)
  • Indebtedness payment. By December 31, 1992, the agency must make an additional payment eliminating any indebtedness to the low- and moderate-income housing fund under § 33334.3, reduced by amounts actually spent on principal or interest for pre-existing agency bonds secured by set-aside funds, only to the extent other tax increment above the 20% set-aside was insufficient that year. (b)(2)
  • HCD review. The Department of Housing and Community Development must annually review the calculation of the amount transferred and may audit the funds when the Director deems it appropriate. (c)
  • Obligation satisfied. The transferred amount fulfills the city redevelopment agency’s low- and moderate-income housing obligations under Health & Safety Code §§ 33334.2–33334.16, and use of the funds within the city’s Southern California Association of Governments region is deemed to benefit the city’s project areas. (d)
  • Use of funds. Funds must provide housing and assistance for low- and moderate-income families and individuals in the SCAG region, spent on construction of such housing no more than 15 miles from the nearest City of Industry boundary, in addition to housing otherwise required by the host jurisdiction’s housing element, and may be encumbered only after the Housing Authority files a written expenditure plan with HCD. (e)(1)–(2)
  • Remaining element duty. A qualifying city still must prepare a housing element under § 65583 only to the extent its needs assessment, goals and objectives, and five-year schedule of actions relate to maintaining, preserving, and improving the city’s existing housing. (f)
  • Operative condition. The section does not become operative until a parcel for a high school is transferred under a written agreement between the City of Industry and the Pomona Unified School District and a copy is filed with the Los Angeles County Clerk. (g)
