Delivery to water and sewer providers; priorityTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 3. Local Planning › ARTICLE 10.6. Housing Elements

Key provisions · Claude summary, not statute text

Requires housing elements to be delivered to water and sewer providers and requires those providers to give priority to, and not deny or reduce service to, developments with lower income housing units except on specified findings.

  • Delivery and priority. Adopted housing elements and amendments must be immediately delivered to water and sewer providers in the jurisdiction, which must grant priority for service to proposed developments that include housing units affordable to lower income households. (a)
  • Written policies. Providers must adopt written policies with specific objective standards by July 1, 2006, and at least every five years after (the PUC adopts them for regulated private companies), considering water shortage emergency rules, urban water management plan supply, and other plans for non-urban suppliers and sewer providers. (b)
  • Limits on denial. Providers may not deny, condition, or reduce service to such developments unless they make specific written findings of insufficient water supply or treatment/distribution capacity (shown by engineering analysis), a water shortage emergency, a state compliance order or regional board order prohibiting new connections, insufficient sewer capacity, or the applicant’s failure to agree to generally applicable reasonable terms, including fees under § 66013. (c)
  • Definitions. Defines “proposed developments that include housing units affordable to lower income households” and “water or sewer services” (residential pipe service, excluding wholesale water sales, and only from regulated public water systems). (d)
  • Scope. The section neither enlarges nor diminishes housing element authority; failure to deliver the element does not invalidate approvals or excuse providers; it covers special districts providing water or sewer service and applies to all cities and counties, including charter cities. (e), (f)
