  • Subsidized farmworker housing. Housing for agricultural employees for very low, low-, or moderate-income households with public financial assistance and legal commitments keeping units available to low- and moderate-income households for at least 15 years. (a)(2)
  • Urban sites. Within city limits or a census-defined place of at least 5,000 persons per square mile, the site must adjoin developed land on at least two sides and have no more than 45 units, or group housing for 45 or fewer agricultural employees. (b)(1)
  • Agricultural sites. On land zoned general agricultural, the project may have no more than 20 units, or group housing for 20 or fewer agricultural employees. (b)(2)
  • Size and criteria. The project must meet § 21159.21 and be no more than five acres, or two acres where population density is at least 1,000 persons per square mile. (b)(3)–(4)
  • Lower-density places. A project not meeting (b)(1) is still exempt if in a city or census-defined place of at least 1,000 persons per square mile, adjacent to developed land on two sides, with no more than 45 units or group housing for 45 or fewer agricultural employees. (c)
  • Exceptions. CEQA still applies to a subdivision (c) project if the agency finds a reasonable possibility of a significant effect due to unusual circumstances or significant cumulative impacts of successive similar projects. “Agricultural employee” is defined by Labor Code § 1140.4(b). (d)
