Prohousing designation incentivesTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 3. Local Planning › ARTICLE 10.6. Housing Elements

Key provisions · Claude summary, not statute text

Creates the prohousing designation program, giving jurisdictions with compliant housing elements and prohousing local policies extra points or preference in specified state housing and infrastructure funding programs.

  • Legislative intent. Incentives are to be additional points or preference in competitive programs, with criteria that consider the differing needs of rural, suburban, and urban jurisdictions. (a)
  • Scoring benefit. For award cycles after July 1, 2021, jurisdictions with a compliant housing element and a prohousing designation receive additional points or preference in the AHSC Program, Transformative Climate Communities Program, Infill Incentive Grant Program of 2007, Infill Infrastructure Grant Program of 2019, and other programs where already allowed. (b)
  • Designation. HCD designates prohousing jurisdictions under permanent regulations and reports them to the Office of Land Use and Climate Innovation annually and on request. (c)(1)
  • Small rural jurisdictions. Beginning with the seventh cycle, HCD must, on request and to the extent feasible, review a compliant small rural jurisdiction’s housing element submission for evidence of prohousing policies, and may not require renewal of their designations for at least four years (revocation authority is preserved). (c)(2)–(3)
  • Homelessness policy points. Points for policies in (f)(3)(L)–(N) may not exceed the minimum points for a policy directly related to planning, approving, or constructing housing. (c)(4)
  • Regulations and list. HCD was to adopt emergency regulations by July 1, 2021, effective until permanent regulations take effect, and must publish the list of covered programs annually starting January 1, 2021. (d), (e)
  • Definitions. Defines “adaptive reuse,” “compliant housing element,” “prohousing local policies” (including local housing trust funds, reduced parking, by-right zoning, zoning beyond RHNA, ADU measures, faster permitting, objective standards, reduced impact fees, Workforce Housing Opportunity Zones or housing sustainability districts, preserving project-based rental assistance, commercial-to-housing conversion, safe parking and safe camping programs, and expediting navigation centers, shelters, and supportive housing), and “small rural jurisdiction” (a city under 25,000 or county under 200,000 population). (f)
