Key provisions · Claude summary, not statute text

  • Eligible projects. A residential project on an infill site within an urbanized area that meets § 21159.21, with community-level environmental review certified or adopted within five years of the application being deemed complete under Gov. Code § 65943. (a)(1)–(4)
  • Project limits. The site may not exceed four acres, the project may not exceed 100 residential units, it must be within one-half mile of a major transit stop, and no single level building may exceed 100,000 square feet. (a)(5)–(6), (a)(8)–(9)
  • Affordability. Code § 65589.5(h)(3); or payment of in-lieu fees under a local ordinance sufficient to produce an equivalent number of units. (a)(7)
  • Higher density. The project must promote higher density infill housing; 20 units per acre is conclusively presumed to do so, and at least 10 units per acre above the average density within 1,500 feet is presumed to unless a preponderance of evidence shows otherwise. (a)(10)
  • Exceptions. CEQA applies if there is a reasonable possibility of a project-specific significant effect due to unusual circumstances, or substantial changes or new information, not knowable at the time, arise since the community-level review. (b)
  • Limited review. If an exception applies, the EIR or negative declaration is limited to project-specific effects and effects tied to the changed circumstances or new information. (c)
  • Definitions. “Residential” means residential units only, or with primarily neighborhood-serving goods, services, or retail uses not exceeding 25 percent of total building square footage. (d)
