Key provisions · Claude summary, not statute text

Allowed Napa County to meet up to 15 percent of its lower income regional housing need by funding and constructing affordable units in cities within the county, subject to agreements, approvals, findings, and reporting conditions.

  • Transfer authority. During its current planning period, Napa County may meet up to 15 percent of its lower income housing need by committing funds to construct affordable units in one or more cities within the county, only after all listed conditions are met. (a)
  • Agreement contents. The county and receiving city must execute an agreement after public hearings, including a construction plan and schedule, sites by street address, whether sites were in the city’s housing element lower income inventory or are new, and the number and percentage of need previously transferred. (a)(1)
  • COG approval. The council of governments must approve each agreement considering § 65584(a) criteria; if it does not act within 45 days of receipt, the agreement is deemed approved. (a)(2)
  • No double counting. The receiving city must agree not to count the units toward its own share of the regional affordable housing need. (a)(3)
  • Required findings. Based on substantial evidence, the county and city must find that the city has adequate, appropriately zoned sites for both its own share and the transferred units, any needed subsidy or financing is available, and the city’s housing element has been found in compliance by HCD. (a)(4)
  • Replacement sites. If the sites were previously identified for the city’s lower income need, the city must amend its housing element to identify replacement sites by street address, and HCD must find the element still complies. (a)(5)
  • Reporting. Both jurisdictions must have submitted their § 65400(b) annual reports, and for five years after a transfer those reports must cover the status of transferred units, implementation of the agreement, and units built (number, type, location, affordability). (a)(6)–(7)
  • City performance. The receiving city must show it met at least 20 percent of its very low income regional need in the current or previous cycle. (a)(8)
  • Credit limits. The county’s credit may not exceed 40 percent of lower income units constructed and occupied in unincorporated areas in the same cycle, is given only after units are built and occupied, and the county must notify the COG and HCD in writing within 60 days of a certificate of occupancy. (b)
  • HCD evaluation. Concurrent with COG review, HCD must evaluate whether the city is in substantial compliance and report results to the county and city. (c)
  • Unbuilt units. If units are not constructed by the end of the five-year period, or the COG finds paragraphs (5) and (7) were not substantially complied with, the unbuilt units are added to Napa County’s share for the next planning period. (d)
  • Sunset. Napa County may not meet any share under this section on or after June 30, 2007, unless a statute enacted before that date deletes or extends it. (e)
