Capital improvement programs of special and school districtsTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 3. Local Planning › ARTICLE 7. Administration of General Plan

Key provisions · Claude summary, not statute text

Authorizes special districts, school districts, and joint powers agencies that build or maintain urban public facilities to prepare a five-year capital improvement program, which is then reviewed for general plan consistency.

  • Optional program. Such districts and agencies may prepare a five-year capital improvement program; the section applies only if the district or agency specifically determines to implement it and does not limit other capital improvement planning methods. (a)
  • Definitions. “Public facilities” includes public buildings and schools; nonagricultural water, sewage, and storm water and flood control facilities; electricity generation and gas and electric distribution; transportation and transit facilities; and parks and recreation facilities (excluding park districts with annual operating budgets of $100,000 or less). (a)(1)–(7)
  • Program contents. The program shall show location, size, time of availability, financing (including a bond repayment schedule), operation cost estimates, a maintenance and rehabilitation schedule, and estimated useful life of existing and proposed improvements. (b)
  • Adoption and consistency review. The program is adopted and annually reviewed and extended by resolution; at least 60 days before adoption or revision it is referred to affected city and county planning agencies, whose failure to report within 40 days is deemed a consistency finding. The district may not carry out inconsistent portions unless it overrules the finding. (c)
  • Public hearing. At least one public hearing is required before adoption or annual revision, with notice under § 65090 and mailed notice to any significantly affected city or county. (d)
