Key provisions · Claude summary, not statute text

Defines the terms used in the article, including the cities and counties it covers and the “protected units” that must be replaced.

  • Affected city. A city, including a charter city, that the Department of Housing and Community Development determines is in an urbanized area or urban cluster designated by the United States Census Bureau, but not a city of 5,000 or less that is not in an urbanized area. (a)(1)
  • Affected county. A census-designated place, based on the 2013–2017 American Community Survey 5-year Estimates, wholly within an urbanized area. Both terms include the electorate of an affected city or county exercising its local initiative or referendum power. (a)(2)–(3)
  • Protected units. Residential units that are or were, within the past five years, rent-restricted by recorded covenant, ordinance, or law to lower or very low income levels, subject to rent or price control, or rented by lower or very low income households, or that were withdrawn from rent or lease under the Ellis Act within the past 10 years. (h)
  • Replace. Has the meaning in § 65915(c)(3)(B) and (C); for a development of a single residential unit on a site with a single protected unit, “replace” means replacement with a unit of any size at any income level. (i)
  • Equivalent size. Replacement units contain at least the same total number of bedrooms as the units being replaced. (d)
  • Cross-referenced terms. “Affordable housing cost,” “affordable rent,” “persons and families of low or moderate income,” “lower income households,” and “very low income households” have their Health and Safety Code meanings, and “housing development project” has its § 65905.5(b)(3) meaning. (b)–(c), (e)–(g), (j)
