Commercial development bonuses for partnered housingTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4.3. Density Bonuses and Other Incentives

Key provisions · Claude summary, not statute text

Requires a city or county to grant a commercial development bonus to a commercial developer that partners with a housing developer to provide affordable housing on or near the commercial site. The section is repealed January 1, 2028.

  • Commercial bonus. A commercial applicant with an approved partnered housing agreement must receive a development bonus. Housing must be on the commercial site or on a site within the jurisdiction, close to schools and employment centers, and within one-half mile of a major transit stop. (a)
  • Bonus options. Mutually agreed incentives may include up to 20% increases in general plan intensity, floor area ratio, or height, up to a 20% parking reduction, a limited-use/limited-application elevator, or an exception to a zoning or land use regulation. (b)
  • Partnership agreement. The agreement is between the commercial and housing developers, identifies how affordable housing is contributed, and is approved by the city or county. Contributions may be by building units directly, donating land, or making a cash payment toward construction. (c), (d)
  • Replacement and other incentives. § 65915(c)(3)(A) applies, and other local allowances or incentives are not precluded. (e), (f)
  • Occupancy withholding. If the affordable units are not started on the agreed timeline, the local government may withhold commercial certificates of occupancy until the affordable units are complete. (g)
  • Minimum affordability. The partnering housing developer must provide at least 30% of units for low-income households or 15% for very low income households. (h)
  • Density bonus and fees. The affordable developer may still seek § 65915 benefits, but the commercial bonus may not reduce or waive affordable housing fee requirements on the commercial developer. (i), (j)
  • Annual reporting. Cities and counties must report approved commercial development bonuses to HCD in the § 65400 annual report, including agreement terms and affordable units built. (k)
  • Definitions. Defines “partner” as a jointly owned entity or a contract between the commercial applicant and affordable housing developer to develop both properties. (l)
  • Sunset. The section remains in effect only until January 1, 2028, and is then repealed. (m)
