Gov. Code § 66300.6

Replacement of demolished and protected unitsTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 12. Housing Crisis Act of 2019 › ARTICLE 2. Demolition of Housing Units

Key provisions · Claude summary, not statute text

Bars an affected city or county from approving projects that demolish housing unless they create at least as many units and, where protected units are involved, replace them and protect existing occupants.

  • No net loss of units. A housing development project that requires demolition of residential dwelling units may not be approved unless it creates at least as many units as will be demolished, except as provided in § 66300.6.5. (a)
  • Replacement of protected units. A development project that demolishes occupied or vacant protected units, or is on a site where protected units were demolished in the previous five years, must replace all existing protected units and those demolished on or after January 1, 2020. Replaced units count toward § 65915 or a local inclusionary requirement. (b)(1)(A)–(B)
  • Industrial use exception. The replacement requirement does not apply to an industrial use project entirely within a zone that does not allow residential uses, adopted before January 1, 2022, where the protected units are or were nonconforming uses. (b)(1)(C)
  • Unit count and offsite replacement. A housing development project must include at least as many units as the greatest number on the site within the last five years. For a project that is not a housing development project, required replacement housing must be developed before or concurrently, may be offsite, and must be in the same jurisdiction. (b)(2)
  • Occupancy and notice. Existing occupants may stay until six months before construction and must receive written notice of the demolition, the vacate date, and their rights at least six months in advance; if the demolition does not proceed and the property returns to the rental market, they may return at their prior rental rate. (b)(3)
  • Relocation and first refusal. Lower income occupants of protected units receive relocation benefits equivalent to those required of public entities and a right of first refusal for a comparable unit at an affordable rent or affordable housing cost. The right of first refusal does not apply to a single unit replacing a single protected unit, to 100 percent lower income developments (unless the occupant qualifies and a comparable unit is not precluded by funding requirements), or to industrial-exception projects. (b)(4)(A)–(B)
  • Comparable unit. Where protected single-family homes are replaced in a project of two or more units, a “comparable unit” has the same number of bedrooms (if three or fewer) or three bedrooms (if four or more), and need not have the same square footage or total rooms. The paragraph does not apply to short-term rental occupants of fewer than 30 days, and unlawful occupants gain no additional protections. (b)(4)(C)–(D), (b)(5)
  • Local ordinances and exemption. The section does not supersede objective local ordinances that are more protective of lower income households, require more affordable units, or require greater relocation assistance. It does not apply to applications submitted after January 1, 2019, but before January 1, 2020, in a jurisdiction under 31,000 population (2020 Census) with a rent or price control ordinance. (c)–(d)
