Key provisions · Claude summary, not statute text

Beginning with the April 1, 2027 annual report, allows a jurisdiction to count existing multifamily units converted to long-term affordable housing for lower income households toward up to 25 percent of its lower income RHNA, subject to tenant protections and other conditions.

  • Definitions. “Acutely low income,” “extremely low income,” “low income,” and “very low income” have the § 65582 meanings; “affordable housing cost” and “affordable rent” have the Health and Safety Code §§ 50052.5 and 50053 meanings. (a)
  • Reporting conversions. Beginning with the report due April 1, 2027, for up to 25% of the RHNA for low, very low, extremely low, or acutely low income households, the planning agency may report existing multifamily units converted to affordable housing with covenants of at least 55 years; the report must state the units are not newly constructed and include § 65400(a)(2)(H) project- and unit-level information. (b)
  • Unit eligibility. A unit qualifies only if it had no prior affordability covenants, is under a recorded regulatory agreement with a public entity for at least 55 years, is decent, safe, and sanitary after conversion (including any initial rehabilitation), and is under a governmental monitoring program for the full term. (c)(1)–(2), (c)(5)–(6)
  • Tenant protections. Existing households may not be evicted or have their tenancy terminated based on income or eligibility requirements, and occupants temporarily displaced by rehabilitation must have been provided temporary replacement housing. (c)(3)–(4)
  • Income categories. Reported units must be separated into acutely low, extremely low, very low, and low-income units. (d)
