Gov. Code § 65402

Property and public works consistency with the general planTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 3. Local Planning › ARTICLE 7. Administration of General Plan

Key provisions · Claude summary, not statute text

Requires public property acquisitions and dispositions, street vacations, and public buildings to be submitted to the planning agency for a report on conformity with the adopted general plan before proceeding.

  • Local conformity review. Where a general plan applies, no real property may be acquired or disposed of for public purposes, no street vacated or abandoned, and no public building constructed or authorized until the planning agency reports on its conformity with the general plan; the report is due within 40 days or a longer period set by the legislative body. (a)
  • Local exemptions. By ordinance or resolution, the legislative body may exempt minor dispositions of remainder parcels acquired for streets, acquisitions, dispositions, or abandonments for street widening, and alignment projects. (a)
  • Cross-jurisdiction projects. A county acting in another county or in a city, or a city acting in another city or unincorporated territory, must first submit the action to the planning agency having jurisdiction; failure to report within 40 days is conclusively deemed a finding of conformity. Minor street widening or alignment projects may be exempted by the host jurisdiction’s ordinance or resolution. (b)
  • Other local agencies. A “local agency” (a state agency performing local functions within limited boundaries, excluding the state, counties, and cities) must likewise submit acquisitions, dispositions, and public buildings for review; failure to report in 40 days is deemed a conformity finding, and the local agency may overrule a planning agency disapproval. (c)
