Upzoning for up to 10 units near transit or urban infill (SB 10)TITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4.2. Housing Development Approvals

Key provisions · Claude summary, not statute text

Allows a local government to adopt an ordinance zoning parcels in transit-rich areas or urban infill sites for up to 10 units per parcel, notwithstanding local limits on its zoning authority, with the ordinance exempt from CEQA.

  • Upzoning authority. A local government may zone a parcel for up to 10 units at a height it specifies if the parcel is in a “transit-rich area” or on an “urban infill site,” even over local restrictions on zoning, including local initiatives. (a)(1)
  • Deadline. No ordinance may be adopted on or after January 1, 2029, though its operative date may extend beyond that date. (a)(2)
  • CEQA. The ordinance and conforming general plan or other amendments are not a “project” under CEQA. (a)(3)
  • Exclusions. Does not apply to parcels in very high fire hazard severity zones or high or very high zones on CAL FIRE maps (unless fire mitigation measures are adopted), or to initiative restrictions designating public land as open space, parks, or recreation. (a)(4)
  • Adoption requirements. The ordinance must declare it is adopted under this section, clearly demarcate zoned areas, and include a finding of consistency with affirmatively furthering fair housing; an ordinance superseding an initiative requires a two-thirds vote. (b)
  • Larger projects. Projects of more than 10 new units on parcels zoned under this section may not be approved ministerially or by right and are not CEQA-exempt. This does not apply after a later rezoning, ADUs and JADUs (up to two each) do not count, and projects may not be split to avoid the rule. (c)
  • No density reduction. The ordinance may not reduce, and the legislative body may not later reduce, the density of any parcel subject to it. (d)
  • Definitions. Defines “high-quality bus corridor” (by peak, weekday, and weekend service intervals of 15, 20, and 30 minutes), “transit-rich area,” and “urban infill site.” (e)
  • Charter cities. Adequate housing is a matter of statewide concern, so the section applies to all cities, including charter cities. (f)
