Submitting ADU ordinances to HCDTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 13. Accessory Dwelling Units › ARTICLE 2. Accessory Dwelling Unit Approvals

Key provisions · Claude summary, not statute text

Requires local ADU ordinances to be submitted to HCD and sets the process for HCD findings of noncompliance and the consequences.

  • Submittal. A local agency must submit its § 66314 ordinance to HCD within 60 days after adoption; HCD may then issue written findings on compliance. (a)
  • Response to findings. If HCD finds noncompliance, it must give the agency a reasonable time, no longer than 30 days, to respond. The agency must either amend the ordinance or adopt it unchanged with findings explaining why it complies despite HCD's findings. (b)
  • Enforcement. If the agency does neither, HCD must notify the agency and may notify the Attorney General of a violation of state law, after possibly considering whether the agency adopted a compliant ordinance between January 1, 2017, and January 1, 2020. (c)
  • Null and void. Failure to submit within 60 days or respond within 30 days makes the ordinance null and void, and the agency must apply the article's standards until it adopts a compliant ordinance, including meeting submittal requirements. (d)
