Gov. Code § 66329

Coastal Act and other lawsTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 13. Accessory Dwelling Units › ARTICLE 2. Accessory Dwelling Unit Approvals

Key provisions · Claude summary, not statute text

Preserves the California Coastal Act while setting 60-day, hearing-free timelines for coastal development permits for ADUs.

  • Local coastal permits. The article does not alter the Coastal Act, except that the local government must approve or deny an ADU coastal development permit within 60 days of a complete application, without public hearings, concurrently with the § 66317 ADU review. (a)
  • No certified LCP. Where there is no certified local coastal plan or program, the local government must immediately notify the Coastal Commission when an ADU application is complete, and the Commission must approve or deny within 60 days, concurrently with § 66317 review once it has a complete application under § 65943. (b)(1)–(3)
  • Delay and deemed approval. The Commission may delay an ADU permit submitted with a new single-family or multifamily dwelling permit until it acts on that permit; otherwise an application not acted on within 60 days is deemed approved. (b)(4)–(5)
  • No appeal. Local decisions under subdivision (a) are not appealable under Public Resources Code § 30603. (c)
