Separate sale of ADUs to qualified buyersTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 13. Accessory Dwelling Units › ARTICLE 4. Accessory Dwelling Unit Sales

Key provisions · Claude summary, not statute text

Requires local agencies to allow an ADU to be sold or conveyed separately from the primary residence to a “qualified buyer” when specified nonprofit, deed, and tenancy-in-common conditions are met.

  • Nonprofit development. The ADU or primary dwelling must have been built or developed by a “qualified nonprofit corporation.” (a)
  • Recorded restriction. There must be an enforceable land use restriction under a recorded contract between the qualified buyer and the nonprofit meeting Revenue and Taxation Code § 402.1(a)(10). (b)
  • Tenancy in common. The property must be held under a recorded tenancy in common agreement allocating undivided, unequal interests by dwelling size; giving the nonprofit a first repurchase option; requiring principal-residence occupancy; and imposing affordability restrictions preserving the units for low-income housing for 45 years for owner-occupied units, with resale to qualified buyers. (c)(1)–(4)
  • Post-2021 agreements. Agreements recorded after December 31, 2021, must also delineate exclusive-use areas, each cotenant's responsibility for taxes, insurance, utilities, maintenance, improvements, and other costs (binding only among the parties), and dispute resolution procedures before legal action. (c)(5)
  • Deed and utilities. A grant deed must be recorded in the county with a concurrent Preliminary Change of Ownership Report; notwithstanding § 66324, the ADU must have a separate water, sewer, or electrical connection if the utility requests it. (d), (e)
  • Condominiums. This section does not limit separate sale of an ADU as a condominium under an ordinance adopted under § 66342. (f)
