Key provisions · Claude summary, not statute text

Sequences certificates of occupancy for ADUs after the primary dwelling, with an exception for disaster-affected counties.

  • Sequencing. A certificate of occupancy for an ADU may not be issued before one is issued for the primary dwelling. (a)
  • Emergency exception. In a county under a Governor's state of emergency proclaimed on or after February 1, 2025, the agency must issue an ADU certificate of occupancy even if the primary dwelling has none, if the primary dwelling was substantially damaged or destroyed by the event and the ADU has construction permits and passed all required inspections.
