  • Davis-Stirling and SMA. Condominiums must be created under the Davis-Stirling Common Interest Development Act and conform to all applicable objective requirements of the Subdivision Map Act and local subdivision ordinance. (a), (b)

  • Lienholder consent. No subdivision map or condominium plan may be recorded without each lienholder's consent, which may be refused or conditioned. Written consent with specified statement language, signature, owner name, legal description, and interested parties must accompany the plan and be recorded with the county recorder. (d)
  • Consumer notice. The agency must include a specified “NOTICE” on ADU and JADU submittal checklists, public information, and as a standard permit or plan approval condition, describing recording and lender-consent requirements and possible lender conditions. (e)
  • Utility notice. If an ADU becomes a condominium, the homeowner must notify water, sewer, gas, and electricity providers of the creation and separate conveyance. (f)
  • Existing associations. In a planned development with an existing association, a condominium plan may not be recorded without the association's express written authorization, meaning board approval at a duly noticed meeting and, if required by governing documents, membership approval. (g)
  • Limit on separate sale. An ADU may be sold or conveyed separately from the primary residence only under these conditions or pursuant to the article. (h)
