Ministerial review of junior ADU permitsTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 13. Accessory Dwelling Units › ARTICLE 3. Junior Accessory Dwelling Units

Key provisions · Claude summary, not statute text

Sets the ministerial permit process, completeness and approval deadlines, denial comments, fees, and appeal rights for JADU applications.

  • Ministerial review. JADU permit applications must be considered ministerially, without discretionary review or a hearing, notwithstanding §§ 65901 or 65906 or local variance or special use permit rules. (a)(1)
  • Completeness. The agency must determine completeness and give written notice within 15 business days, listing incomplete items and how to cure them. A resubmittal may not be required to include unlisted items, is subject to the same timeline, and an untimely determination means the application is deemed complete. (a)(2)
  • 60-day decision. The agency must approve or deny within 60 days of a complete application when there is an existing single-family dwelling. If filed with a new single-family dwelling application, the JADU decision may be delayed until that decision, but remains ministerial. An applicant-requested delay tolls the 60 days. (a)(3)–(5)
  • Denial comments. On denial, the agency must, within the same period, give written comments listing defective or deficient items and how to remedy them. (b)
  • Fees and grounds. The agency may charge a fee to reimburse permit costs. No local rule other than a JADU ordinance consistent with the article may be the basis for delaying or denying a building or use permit. (c), (d)
  • Appeals. The agency must provide a written appeal of incompleteness or denial to the governing body (or director); a city or county may route it to the governing body, the planning commission, or both. A final written determination is due within 60 business days, not extended by two levels of appeal. (e)
