Requires ministerial approval of building permits in residential or mixed-use zones for specified ADU and JADU types, notwithstanding §§ 66314–66322, and limits the standards that may be applied to them.

  • Conversion units. One ADU and one JADU per lot with a proposed or existing single-family dwelling, within proposed or existing dwelling or accessory structure space (an accessory structure may expand up to 150 sq. ft., limited to ingress and egress), with exterior access, side and rear setbacks sufficient for fire and safety, and JADU compliance with Article 3 (§ 66333 et seq.). (a)(1)
  • Detached new unit. One detached new-construction ADU with no more than four-foot side and rear setbacks on a single-family lot; the agency may limit it to 800 sq. ft. of livable space and the applicable height under § 66321(b)(4)(A)–(C). (a)(2)
  • Multifamily conversions. Multiple ADUs within non-livable portions of existing multifamily structures (storage rooms, boiler rooms, passageways, attics, basements, garages) that meet state building standards; at least one, and up to 25 percent of existing multifamily units, must be allowed. (a)(3)
  • Multifamily detached. Detached ADUs on a lot with a multifamily dwelling, subject to § 66321 height limits and setbacks of no more than four feet: up to eight on a lot with an existing multifamily dwelling (not exceeding the number of existing units), or up to two with a proposed multifamily dwelling. An existing building with setbacks under four feet need not be modified. (a)(4)
  • Limits on standards. No objective development or design standard not authorized by this section may be imposed on qualifying units, and correction of nonconforming zoning conditions may not be required for ministerial approval. (b), (c)
  • Fire sprinklers. Sprinklers may not be required in an ADU or JADU if not required for the primary residence, and construction does not trigger sprinklers in the existing multifamily dwelling. (d)
  • Rentals and septic. Rentals of ADUs created under this section must be for terms longer than 30 days. For an ADU connected to an onsite wastewater treatment system, the agency may require a percolation test from the last five years, or 10 years if recertified. (e), (f)
