Gov. Code § 65914.7

Housing on local educational agency landTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4.2. Housing Development Approvals

Key provisions · Claude summary, not statute text

Makes a qualifying affordable housing development an allowable use on real property owned by a local educational agency as of January 1, 2026, with set density, height, and objective-standard rules. The section is repealed January 1, 2036.

  • Size. The housing development must have at least 10 units. (a)(1)
  • Affordability. A recorded deed restriction of at least 55 years must ensure either (A) at least 30% lower income and 20% moderate-income rents, or (B) at least 12% very low income, 15% lower income, and 20% moderate-income rents. (a)(2)
  • Tenant priority. 100% of units are rented, in order, to the agency’s employees, then other local educational agency employees, then local public employees in the jurisdiction, then the general public; vacancies follow the same sequence. (a)(3)
  • Density. Allowable density, measured on the “development footprint,” is the greater of the city or county density or twice the § 65583.2(c)(3) lower income density. (a)(4)
  • Height. The greater of local height or 35 feet where surrounded by single-family zoning or not within one-half mile of a major transit stop; 45 feet for non-metropolitan sites near a major transit stop; 65 feet for metropolitan sites near a major transit stop. (a)(5)
  • Objective standards. The project must meet objective zoning, subdivision, and design review standards of the nearest zone allowing its proposed density (or the highest-density zone), but standards may not preclude the proposed density. Defines the objective standard terms. (a)(6)
  • Other site conditions. The property must be entirely within any urban limit line or urban growth boundary, and the project must comply with infrastructure requirements, including existing or pending impact fees. (a)(7)–(8)
  • Consistency and density bonus. A qualifying project is deemed consistent with local standards, zoning, and the general plan, and is eligible for § 65915 density bonus, incentives, waivers, and parking ratios. (b)
  • Ownership and joint use. The local educational agency must keep ownership for the 55-year affordability period; the land may be jointly used or occupied with others, subject to Education Code Articles 8 and 9. (c), (d)
  • Surplus land exemptions. The land is exempt from the Surplus Land Act (§ 54220 et seq.) and Education Code §§ 17230 et seq. and 17455 et seq. (e)
  • Definitions. Defines “affordable rent,” “development footprint,” “housing development project,” “local agency,” “local educational agency,” “local educational agency employee,” “local public employee,” “lower income households,” “major transit stop,” “moderate-income households,” “real property owned by a local educational agency,” “total units,” and “very low income households.” (f)
  • Review. Local review for objective standards compliance must be consistent with § 65589.5. (g)
  • Sunset. The section remains in effect only until January 1, 2036, and is then repealed. (h)
