Housing at places of worship: parking spacesTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4.2. Housing Development Approvals

Key provisions · Claude summary, not statute text

Limits parking requirements that a local agency may impose on housing development projects on land owned by religious institutions, allowing religious-use parking spaces to be eliminated or reduced, within limits.

  • Definitions. Defines “housing development project,” “local agency,” “place of worship,” “religious institution,” “religious institution affiliated housing development project” (on religious institution-owned parcels, near religious-use parking, and qualifying for a § 65915 density bonus), and “religious-use parking spaces.” (a)
  • No replacement. A local agency may not require replacement of religious-use parking spaces eliminated or reduced by the project. The reduction may not exceed 50% of existing spaces, or 50% of spaces required for a new place of worship, and is not a density bonus concession. (b)
  • Deficits and counting. An agency may not require curing a preexisting parking deficit and must let remaining religious-use spaces count toward the project’s required parking. (c), (d)
  • Denial. An agency may not deny a project solely because it reduces parking at the place of worship, if the reduction does not exceed 50% of existing or newly required spaces. (e)
  • Minimum parking. The reductions may not lower required parking below one space per unit, except for parcels within one-half mile walking distance of “public transit” or within one block of a car share vehicle. (f)
  • EV and accessible parking. Does not reduce requirements for electric vehicle supply equipment or accessible parking spaces. (g)
  • Charter cities. Applies to all cities, including charter cities, as a matter of statewide concern. (h)
