Bonds in suits challenging housing approvalsTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4.2. Housing Development Approvals

Key provisions · Claude summary, not statute text

Allows a court to award costs and attorney’s fees to a prevailing public entity or nonprofit housing corporation defending a low- and moderate-income housing approval against a frivolous suit.

  • Fee award. In an action (including under Pub. Resources Code § 21167) to enjoin or obtain a writ against approval of a housing development, after final judgment and the appeal period, and after notice to plaintiffs, the court may award all reasonably incurred costs, including attorney’s fees, to the prevailing public entity or nonprofit housing corporation that is the real party in interest and permit applicant. (a)
  • Required findings. The court must find that the development meets § 65915 low- and moderate-income requirements; the action was frivolous and aimed primarily at delaying or thwarting the project’s affordability; the entity prevailed on all issues and actively took part in the defense; and a preliminary injunction was denied or the case was dismissed on summary judgment, without reversal on appeal. (a)(1)–(4)
  • Appeals. On appeal, the reviewing court may award costs and attorney’s fees if it upholds the trial court’s findings under (a)(1)–(4). (b)
  • Other remedies. The section does not limit any other remedies or rights provided by law. (c)
