Key provisions · Claude summary, not statute text

Establishes minimum remedies, including attorney’s fees and fines, when a housing applicant prevails against a public agency for violating a “housing reform law,” and bars agencies from requiring applicants to indemnify them in such suits.

  • Legislative intent. Intends to set minimum uniform, transparent, fair, and effective remedies against public agencies that violate housing reform laws, and to prevent agencies from undermining them through reimbursement and indemnification agreements. (a)
  • Attorney’s fees. When an applicant prevails in an action to enforce a housing reform law as applied to its project, the applicant is entitled to reasonable attorney’s fees and costs, in addition to other remedies. (b)(1)
  • Fines after warning. If the Attorney General or HCD advised a local agency in writing before the action that its conduct would violate a specific housing reform law substantially as alleged, the court must impose a fine of at least the § 65589.5(k)(1)(B) minimum fines, or at least $50,000 per violation for projects of four or fewer units. (b)(2)(A)(i)(I)
  • Notice requirement. The fine applies only if, after the AG or HCD communication, the applicant gives the local agency written notice of intent to sue at least 60 days before filing, identifying the facts and legal theory; limitation periods are extended 60 days from that notice. (b)(2)(A)(i)(II)–(III)
  • Repeat violations. If a court previously found the agency violated the same housing reform law within the same planning period, the fine is at least the minimum fine multiplied by five; a later violation counts as in the same planning period if the agency lacks a substantially compliant housing element under § 65585.03. (b)(2)(A)(ii)
  • Claims and other fees. The applicant need not present a Government Claims Act claim to seek the fine, and the section does not limit fees under Code Civ. Proc. § 1021.5. (b)(2)(B)–(C)
  • Indemnification ban. A public agency may not require a housing applicant to indemnify, defend, or hold it harmless in actions by the applicant or others alleging the agency violated the applicant’s rights under a housing reform law; such requirements or agreements are void and unenforceable, without derogating claims they were already unlawful. (c)
  • Definitions. Defines “housing development project” (§ 65905.5(b)(3)), “housing reform law,” “local agency” (§ 65930), “planning period,” and “public agency” (§ 65932). (d)
