18-month extension of housing entitlementsTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4.2. Housing Development Approvals

Key provisions · Claude summary, not statute text

Extends by 18 months the expiration, effectuation, or utilization period of qualifying housing entitlements issued and in effect on January 1, 2024, that will expire before December 31, 2025.

  • 18-month extension. Notwithstanding any law or local plan, a housing entitlement issued before and in effect on January 1, 2024, that will expire before December 31, 2025, is extended by 18 months, including any deadline to request a building permit. (a)
  • No double extension. An entitlement already extended by the state or a local agency for at least 18 months on the same conditions on or after January 1, 2024, and before this section took effect, is not extended again. (b)
  • Definitions. “Housing entitlement” includes state approvals, local Chapter 4.5 approvals, ministerial prerequisites to a building permit, deadlines to apply for a building permit, approved tentative, vesting tentative, or parcel maps, and associated vested rights; it excludes development agreements, tentative maps extended at least 24 months under § 66452.6 on or after January 1, 2024, and preliminary applications. Also defines “housing development project” (at least two-thirds residential square footage, counting § 65915 bonuses and excluding underground space) and “local agency.” (c)
  • Tolling. The extension is tolled while the entitlement is the subject of a legal challenge. (d)
  • Local authority. Local governments keep their existing authority to grant extensions. (e)
  • Charter cities. The section addresses a matter of statewide concern and applies to all cities, including charter cities. (f)
