COVID-19 extension of housing entitlementsTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4.2. Housing Development Approvals

Key provisions · Claude summary, not statute text

In response to the COVID-19 pandemic-induced recession, extends by 18 months qualifying housing entitlements issued and in effect on March 4, 2020, that would expire before December 31, 2021.

  • Findings. Recites the COVID-19 emergency declarations, economic contraction, job losses, strain on local planning services, and the existing housing affordability crisis, and finds a uniform statewide entitlement extension necessary. (a)
  • 18-month extension. Notwithstanding any law or local plan, a housing entitlement issued before and in effect on March 4, 2020, that will expire before December 31, 2021, is extended by 18 months, including any deadline to request a building permit. (b)
  • No double extension. An entitlement already extended for at least 18 months on the same conditions on or after March 4, 2020, and before this section took effect, is not extended again. (c)
  • Definitions. “Housing entitlement” includes state approvals, local Chapter 4.5 approvals, ministerial prerequisites to a building permit, deadlines to apply for a building permit, and associated vested rights; it excludes development agreements, tentative maps extended at least 18 months under § 66452.6 on or after March 4, 2020, preliminary applications, and § 65913.4 approvals and subsequent permits. Also defines “housing development project” (approved maps, residential, or mixed use at least two-thirds residential) and “local agency.” (d)
  • Tolling. The extension is tolled while the entitlement is the subject of a legal challenge. (e)
  • Local authority and charter cities. Local governments keep existing extension authority, and the section applies to all cities, including charter cities, as a matter of statewide concern. (f), (g)
