Key provisions · Claude summary, not statute text

Requires “major transit cities” to designate regional transit hub districts by July 1, 2027, where “downtown housing developments” are allowed at specified minimum heights, FARs, and densities and are eligible for density bonuses and streamlined ministerial approval under § 65913.4.

  • Definitions. Defines “downtown housing development” (meets § 65913.4(a)(8) labor standards, at least 60 units per acre, § 65912.157 affordability and site requirements, no demolition of individually landmarked property, airport compatibility, and average unit size of 1,750 net habitable square feet or less), “housing development project,” “major transit city” (population of at least 400,000 with two or more transit-oriented development stops), “regional transit hub district,” and “transit-oriented development stop.” (a)
  • Designation duty. By July 1, 2027, each major transit city must designate at least one regional transit hub district totaling at least 0.5 square miles (400,000 to under 1,000,000 population), one square mile (1,000,000 to under 2,000,000), or 1.5 square miles (2,000,000 or more). (b)(1)
  • Resolution or ordinance. Designation is by resolution if existing zoning is consistent, or by ordinance with the needed zoning amendments. Designation is not a CEQA “project.” (b)(2), (b)(6)
  • Default district. If a major transit city fails to comply, an equivalent area in a uniform radius around its highest ridership transit-oriented development stop (measured July 1, 2026, to July 1, 2027) is deemed a district, located entirely within the city and excluding San Francisco Bay and the Pacific Ocean. (b)(3)
  • Optional districts. Other cities may designate a district, and major transit cities may designate multiple districts that cumulatively meet the requirement. (b)(4)–(5)
  • District requirements. Each district must be a contiguous area of at least 0.25 square miles containing at least one transit-oriented development stop. (c)(1)
  • Development standards. Downtown housing developments are an allowable use, with no maximum height below 150 feet, FAR below six, or density below 200 units per acre. At least 25% of total district area must allow 450 feet, FAR of at least 12, and no maximum density; other objective standards may apply if consistent. (c)(2)
  • Density bonus. A downtown housing development may qualify for density bonuses, incentives, waivers, or parking ratios under § 65915 or a local program, using this section as the base density. (d)(1)
  • Streamlined approval. It is eligible for streamlined ministerial approval under § 65913.4, exempt from that section’s subdivision (a) except paragraphs (6) and (8). (d)(2)(A)–(B)
  • Environmental assessment. A phase I environmental assessment is required, with a preliminary endangerment assessment if a recognized environmental condition is found; releases or hazardous exposures must be remediated or mitigated before a certificate of occupancy is issued. (d)(2)(C)
  • CalHFA study. The California Housing Finance Agency must study housing construction loan programs, gaps, precedents, resources, risks, and stakeholder input, and recommend a state construction loan program, submitting it to the Legislature by March 1, 2028; the reporting requirement becomes inoperative April 1, 2028. (e)
  • Other programs; charter cities. Does not limit local density bonus, incentive-based zoning, or other ministerial standards, and applies to all cities, including charter cities. (f), (g)
