Small infill projects: floor area ratio and lot limitsTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4.2. Housing Development Approvals

Key provisions · Claude summary, not statute text

Prevents local agencies from imposing low floor area ratio limits or minimum lot size denials on qualifying 3- to 10-unit housing projects in multifamily or mixed-use zones in urbanized areas.

  • FAR and lot size. For eligible projects, a local agency may not impose a floor area ratio below 1.0 for three to seven units or below 1.25 for 8 to 10 units, and may not deny a project on an existing legal parcel solely because it does not meet minimum lot size. (a)
  • Eligibility. The project must have 3 to 10 units; be in a multifamily residential or mixed-use zone, not a single-family zone or a historic district, State Historic Resources Inventory property, or local landmark; and be on a legal parcel in a city including part of a Census urbanized area or urban cluster (or wholly within one in unincorporated areas). (b)
  • Other standards. Local agencies may still impose zoning and design standards such as height and setbacks, except FAR or lot size standards that expressly conflict, and may not impose lot coverage that physically precludes the allowed FAR. (c)
  • Definitions. Defines “housing development project,” “local agency,” and “unit,” which excludes ADUs and JADUs. (d)
