Key provisions · Claude summary, not statute text

Requires a local agency to issue building permits for housing projects of 10 or fewer units on a lot being subdivided once a tentative or parcel map is approved, before the final map is recorded.

  • Permit issuance. The local agency must issue a building permit for units in a project of 10 or fewer units if the applicant has received tentative or parcel map approval and submitted a building permit application deemed complete under § 65913.3(b). (a)(1)
  • Occupancy covenant. The agency may require a recorded covenant that no certificate of occupancy or equivalent final approval will issue until the final map is recorded. (a)(2)
  • Map conditions and security. The permit is issued based on the tentative or parcel map and its conditions; dedication, improvement, and sewer requirements must be guaranteed at permit issuance. The agency may require security of no more than 300% of estimated improvement costs, as a surety bond or a qualifying instrument or letter of credit. (a)(3)
  • Denial. The agency may deny the permit if the building official makes a written finding, by a preponderance of the evidence, that building before the final map is recorded would have a specific, adverse impact on public health and safety that cannot feasibly be mitigated or avoided. (a)(4)
  • Ordinance; operative date. A local agency may adopt an implementing ordinance, which is not a CEQA project. The section became operative July 1, 2024. (b), (c)
