Key provisions · Claude summary, not statute text

Sets the affordability requirements a development must meet to qualify for streamlined, ministerial review under § 65912.124.

  • Rental affordability. Rental projects must include 8 percent of base units for very low income and 5 percent for extremely low income households, or 15 percent for lower income households. (a)(1)
  • Campus rental. In a campus development zone, rental projects may instead serve qualifying faculty, staff, or students (5 percent extremely low and 8 percent very low, including students experiencing homelessness, or 15 percent lower income); homeless services providers or institutions may verify homeless status. (a)(2)
  • Rental term. Affordable rental units must remain affordable for 55 years at an affordable rent under Health & Safety Code § 50053. (a)(3)
  • Ownership affordability. Owner-occupied projects must offer 30 percent of base units to moderate-income households or 15 percent to lower income households (including lower income students, faculty, or staff in a campus development zone) at an affordable housing cost, with affordability for 45 years. (b)
  • Local requirements. Where a local affordable housing requirement exists, the project must meet the higher percentage and any deeper affordability level; if the local rule requires over 15 percent lower income without very low/extremely low units, rentals must include 8 percent very low and 5 percent extremely low, and 15 percent is subtracted from the local requirement at the highest affordability level. (c)
  • Unit parity. Affordable units must match market-rate units in bedroom and bathroom ratio, be equitably distributed, and have the same type or quality of appliances, fixtures, and finishes. (d)
