Key provisions · Claude summary, not statute text

A streamlined, ministerial approval process for eligible agricultural employee housing developments.

  • Eligible sites. The development must be on land designated agricultural in the general plan or qualifying land in five named counties, and not on an excluded site such as the coastal zone, wetlands, fire hazard zones, or conservation lands. (a)(1), (a)(2)
  • Deadlines to find ineligibility. A local government must give written reasons within 30 or 60 days, depending on project size, or the development is deemed to meet the site requirements. (b)
  • Objective review only. Any development review or public oversight must be objective, limited to streamlining criteria, finished within 90 or 180 days, and may not inhibit the ministerial approval. (c)
  • Permitted local standards. A local government may apply listed objective standards on water, sewer and utilities, road access, parking, health and safety, and hazard mitigation, and may impose essential fees and exactions. (e), (g)
  • Not discretionary under CEQA. Approval, permit processing, and application of development standards under this section are not discretionary acts under CEQA. (f)
  • Eligible development. The development may not include dormitory-style housing, is limited to 36 units or spaces (150 in the five named counties), must be run by a certified qualified affordable housing organization, and must carry a 55-year affordability covenant. (i)
