30-day completeness determinationTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4.5. Review and Approval of Development Projects › ARTICLE 3. Applications for Development Projects

Key provisions · Claude summary, not statute text

Requires a public agency to determine within 30 days whether a development project application is complete, or the application is deemed complete.

  • 30-day determination. Within 30 calendar days after receiving an application, the agency determines in writing whether it is complete and immediately sends the determination to the applicant. (a)
  • Exhaustive list. If incomplete, the lead agency provides an exhaustive list of incomplete items, limited to items on its submittal requirement checklist, and may not later request new information not stated in that list. The determination must specify how the application can be made complete, with a thorough description of the information needed. (a)
  • Deemed complete. If no written determination is made within 30 days and the application states that it is an application for a development permit, it is deemed complete for purposes of the chapter. (a)
  • Resubmittals. Each resubmittal starts a new 30-day period. Review is limited to whether the supplemented application includes the information required by the list and description, and the application is deemed complete if no timely written determination is made. (a)–(b)
  • Appeal. If the application with submitted materials is found incomplete, the agency provides a written appeal process to its governing body or, if none, its director; for a city or county, the appeal is to the governing body or, at its option, the planning commission, or both. (c)
  • Extensions and fees. The applicant and agency may mutually agree to extend any time limit, and the agency may charge a fee not exceeding the reasonable cost of the service, collected with the application fee. (d)–(e)
  • Lists for housing projects. Each city and county makes its § 65940 lists for housing development projects available in writing and on its website; “development project” includes a housing development project as defined in § 65905.5(b)(3). (f)–(g)
