Key provisions · Claude summary, not statute text

Bars a public agency from requesting new information after accepting an application as complete, and sets notice requirements for projects near military areas.

  • No new information. After accepting an application as complete, the agency may not request new or additional information not specified in its § 65940 list, but may request that the applicant clarify, amplify, correct, or otherwise supplement the required information. (a)
  • Information for final action. The initial application need not include everything needed for final action; before accepting an application, the agency must inform the applicant of listed information that will later be required. (b)
  • CEQA information. The section does not limit an agency's ability to request and obtain information needed to comply with CEQA. (c)
  • Notice to military branches. For a complete application the applicant identified as within 1,000 feet of a military installation, within special use airspace, or beneath a low-level flight path, the agency notifies any branch of the Armed Forces that has provided points of contact to the Office of Planning and Research. Except within 1,000 feet of an installation, no copy is required for a project entirely in an “urbanized area.” (d)
  • Consultation. If a military branch requests it, the agency and applicant consult on the project's effects on military installations, low-level flight paths, or special use airspace, and on alternatives and mitigation. (e)
  • Office of Planning and Research. The office maintains online and provides to agencies maps of low-level flight paths, special use airspace, and military installations, military points of contact, and the minimum contents of the notice. (f)
