Key provisions · Claude summary, not statute text

Requires cities, counties, and special districts to post fees, exactions, affordability requirements, zoning standards, and related reports on their websites.

  • Fee schedule. A current schedule of fees, exactions, and affordability requirements applicable to a proposed housing development project, presented to show which apply to each parcel and the fees for each new water and sewer utility connection, with a written fee schedule or direct link posted. (a)(1)(A)
  • Zoning and application list. All zoning ordinances and development standards, specifying the zoning, design, and development standards that apply to each parcel, and the list compiled under § 65940. (a)(1)(B)–(C)
  • Reports and studies. The current and five previous annual fee or financial reports required by §§ 66006(b) and 66013(d), and an archive of impact fee nexus studies, cost of service studies, or equivalent conducted on or after January 1, 2018. (a)(1)(D)–(E)
  • 30-day updates. Posted information must be updated within 30 days of any changes. (a)(2)
  • Fees on completed projects. At certificate of occupancy or final inspection, whichever is last, a city or county requests the total fees and exactions from the development proponent, stating that no response is required and there are no consequences, and posts the information, updated at least twice per year. It is not responsible for accuracy and may include a disclaimer. (a)(3)
  • Affordability requirement. A requirement, as a condition of residential development, that a percentage of units be affordable to moderate-income, lower income, very low income, or extremely low income households, or an alternative means of compliance such as in-lieu fees, land dedication, off-site construction, or acquisition and rehabilitation. (b)(1)
  • Exaction. A construction excise tax, a public art requirement or in-lieu payment, parkland dedications or in-lieu fees under § 66477, or a Mello-Roos special tax on new housing units; it excludes § 66013 fees or charges not imposed in connection with a development permit or as a condition of approval. (b)(2)
  • Fee and housing development project. “Fee” means a fee or charge described in the Mitigation Fee Act. A “housing development project” is residential only, mixed use with at least two-thirds residential square footage, or transitional or supportive housing. (b)(3)–(4)
  • Limits. The section does not alter existing authority to impose an exaction or fee and imposes no obligation on any entity other than a city, county, or special district. (c)–(d)
