Key provisions · Claude summary, not statute text

Requires local agencies to give a housing development proponent an itemized, good faith estimate of all fees and exactions after final approval.

  • City and county estimate. Upon final approval of a housing development project, the city, county, or city and county provides the development proponent an itemized list and good faith estimate of the total of all fees and exactions that will apply, within 30 business days. (a)(1)
  • Other agencies. For fees imposed by other agencies, including school and special districts, the proponent requests the estimate and the agency provides it within 30 business days. (a)(2)
  • Cost recovery fees. An agency that calculates fees using a cost recovery method estimates them based on the average amount imposed on similar projects. (b)
  • Not binding. The list and estimate are for informational purposes only, are not legally binding on the agency, and do not affect the scope, amount, or time of payment of fees or exactions under other law. (c)
  • Definitions. “Exaction” includes construction excise taxes, public art requirements or in-lieu payments, parkland dedications or in-lieu fees, and Mello-Roos special taxes; “fee” means Mitigation Fee Act fees other than local publicly owned utility electrical or gas service; “final approval” means all approvals needed to apply for and obtain building permits; and “public agency” means a city, county, or special district. (d)
