CEQA determinations as disapprovalTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 3. Local Planning › ARTICLE 10.6. Housing Elements

Key provisions · Claude summary, not statute text

Lets a local agency’s failure to determine whether a qualifying infill housing project is exempt from CEQA, or its abuse of discretion in that determination, count as a “disapproval” under the Housing Accountability Act when specified site, density, evidence, and notice conditions are met.

  • Site conditions. Substantial evidence must show the project is not on a site listed in § 65913.4(a)(6)(A)–(C) or (E)–(K), or in a very high fire hazard severity zone (or a high or very high zone on state responsibility area maps). (a)(1)
  • Location criteria. The project must be on a legal parcel in an “urbanized area” and either be within one-half mile walking distance of a “high-quality transit corridor” or “major transit stop,” be in a “very low vehicle travel area,” be “proximal” to six or more amenities, or have urban uses adjoining at least 75% of the perimeter or three sides of a four-sided site. (a)(2)
  • Density and exemption. Density must be at least 15 dwelling units per acre, and substantial evidence must show eligibility for the exemption sought and, for a categorical exemption, that no CEQA Guidelines § 15300.2 exception bars it. (a)(3)–(4)
  • Applicant notice. The applicant must give timely written notice of the failure or abuse of discretion, including specified CEQA Guidelines § 15062 information, the exemption citation, reasons, and record excerpts, and the agency must not have made a lawful determination within 90 days. Notice is timely within 35 days of the agency’s non-exempt determination or, if none was given, after 60 days from the application being accepted, determined, or deemed complete, whichever is earlier. (a)(5)(A), (E)–(F)
  • Agency process. Within five working days the agency must post the notice online, send it to persons requesting notices under Pub. Resources Code § 21167(f), and file it with the county clerk; it must consider all comments and may not decide until at least 60 days after notice, and may extend the decision period by up to 90 days by written response if needed to evaluate the evidence. (a)(5)(B)–(D)
  • Definitions. Defines “abuse of discretion” (exclusively: the (a)(1)–(4) conditions are met but the agency does not find the project exempt), “high-quality transit corridor,” “major transit stop,” “proximal” (within one-half mile of a bus station or ferry terminal, or within one mile, or two miles in a rural area, of listed amenities such as grocery stores, parks, pharmacies, clinics, libraries, and schools), “urbanized area,” and “very low vehicle travel area” (residential VMT per capita below 85% of regional or city VMT per capita). (b)
  • No forced exemption. The section does not require an agency to find a project exempt if, on the record, it is not eligible. (c)
  • Sunset. Repealed January 1, 2031. (d)
